GENERAL TERMS
These terms and conditions (hereinafter the “Terms”) define the legally binding terms that are applied to ITfox Oy (hereinafter “ITfox”, “Pawesomer”) website www.pawesomer.com and on its sub-sites (hereinafter “the Site”) and to all its content (hereinafter “the Service”).
Before using the Site and Service, the user must accept the terms and conditions of these Terms. By signing up on the Site or by using the Service, the user accepts and agrees to comply with the Terms. In case the user does not accept the Terms nor understand them, the user shall not sign up on the Site or use the Service in any way.
All rights are reserved by Pawesomer except the rights expressly granted in these Terms.
CONTENT AND USE OF THE SITE
The Site is served to its users as web browser service that can be used with devices containing an Internet browser and as a mobile service that can be used with mobile devices supporting the Service. Pawesomer does not guarantee that the Site and Service can be used with all devices.
Using the Service and signing up on the Site is
subject to a separate price list (www.pawesomer.com/sign-up). The user, however, is liable for all costs and expenses of acquiring the necessary devices and data connections needed for the use of the Service.
The user is entitled to view and download the content of the Site only for personal and non-commercial purposes provided that the user retains all the information regarding copyrights and proprietorship of the content in all taken copies. The content and materials of the Site and Service shall not be modified or edited in any way, copied or publicly presented, displayed or otherwise used for public or commercial purposes without Pawesomer’s up-front written permission. Using the content and materials of the Site on external sites is prohibited.
SIGNING UP ON THE SITE AND SERVICE
These Terms regulate the use of the Site and Service. By signing up on the Site and Service, the user accepts and agrees to comply with the Terms. When signing up , the user is responsible for providing truthful, precise and real-time information of him/herself . The user is also responsible for informing Pawesomer of any changes on his/her personal information. The user assures that he/she will not upload any illegal, inappropriate or harmful material on the Site or Service.
INTELLECTUAL PROPERTY RIGHTS
Intellectual property rights of the information, features and other content of the Site and Service, including copyrights, is owned by Pawesomer. The content of the Site and Service is protected by design, copyright, patent and trademark laws.
The business name and the logo of Pawesomer and its auxiliary firm-names are protected trademarks by the Copyright Act and other laws. Using those marks without Pawesomer ‘s permission is prohibited.
Pawesomer grants the user of the Site and Service a right to view, browse and print the content of the Site for personal use of the users, and to send via email or to share otherwise to wanted recipients, provided that the user retains all the information regarding copyrights and proprietorship of the content in all taken copies. The content and materials of the Site or Service shall not be modified or edited in any way, copied or publicly presented, displayed or otherwise used for public or commercial purposes without Pawesomer ‘s up-front written permission. Using the content and materials of the Site on external sites or services is prohibited.
The documents of the Site or Service that are intended for public use can be used in public communication provided that the source is mentioned. Documents intended for public use include, inter alia, press releases, terms and conditions and lists of prices.
Pawesomer ’s Site can be linked on external sites or services if it is done in good and decent manner and practice. The linked Site must be fully available and seen in the browser and be shown as it is shown on the Site.
PROCESSING OF PERSONAL AND OTHER DATA
Pawesomer collects and stores the data the user provides when signing up on the Site or Service. In addition, Pawesomer collects data and information of the use on the Site or Service. Some of this data may contain personal data. By signing up on the Site, the visitor gives consent to Pawesomer to collect and process his/her personal data according to Pawesomer’s existing Privacy and Customer Register Policy and other terms.
Pawesomer may use cookies and other analysis techniques for collecting, using and storing technical data and information. These techniques are not used to collect any information or data that could be used to identify or recognize a person. These techniques and information are only used to develop the user experience on the Site and Service.
All data mentioned above is used and processed according to Pawesomer ’s existing Privacy and Customer Register Policy.
EXEMPTION FROM LIABILITY
Pawesomer pursues, to the best of its ability, to take care of the functionality of the Site and Service and to repair all possible errors in reasonable time. However, Pawesomer does not grant that the Site or Service is error-free or available at all times without interruption. Pawesomer reserves rights to temporarily modify and remove features and functions of the Site and Service. Pawesomer has the right to develop and alter the Site and Service or stop providing them at any moment.
The Site or Service may contain links to external sites owned and managed by third parties. Pawesomer is not liable for any of these third party sites as the materials and contents on these sites are not managed or administered by Pawesomer. Pawesomer is not liable for any transaction or activities between the user and the third party. A link to an external web site on Pawesomer’s Site is not an expression of support or sales promotion of the external web site or service or of their content or material.
Pawesomer is not liable for any direct or indirect damages caused by the use of third party sites or information on the sites. Pawesomer is not responsible for any direct or indirect damages that may be caused to animals or pets.
MODIFICATIONS AND INDEPENDENCY
Pawesomer reserves the right, at its sole discretion, to change or modify these Terms. If any of these conditions become invalid due to legislative amendments or other reasons, Pawesomer may modify the conditions in a way that they will become valid. The invalidity of a single condition does not affect the validity of other conditions of the Terms or their interpretation. By using the Site and Service the user accepts the new or updated Terms.
APPLICABLE LAW AND DISPUTE RESOLUTION
These Terms shall be construed in accordance with and governed by the laws of Finland. If a possible controversy, claim or dispute relating these Terms cannot be settled by negotiation between the parties, it shall be resolved at the district court of Pirkanmaa in Tampere. A consumer customer has the right to take the controversy of these Terms for The Consumer Disputes Board to resolve (www.kuluttajariita.fi). Before taking the matter to The Consumer Disputes Board, the consumer must contact Local Register Offices’ consumer advice service (www.kuluttajaneuvonta.fi).
A Customer may file a debt claim against Pawesomer either at the district court of Pirkanmaa or at the Finnish district court of the municipality of the judicial district where the Customer is resided. If the Customer does not have a place of residence in Finland, the disputes shall be resolved at the district court of Pirkanmaa.
